You understand and agree that FindMyCareer.com (a) does not warrant that you will receive any employment or job offers through the Site; (b) shall not be responsible for any employment offers, employment screenings, employment decisions, and actual employment presented by third parties; (c) does not guarantee the accuracy, completeness, validity, or timeliness of information listed by any third parties; (d) shall not be responsible for any materials posted by third parties, including, but not limited to, job openings and employment listings; and (e) is neither your employer nor your agent in any regard. You shall use your own judgment, caution, and common sense in evaluating any prospective employers and any information provided by any third party.

Your Access

Certain parts of this Site may be protected by passwords or require a login. You agree to use this Site to access only those accounts on which you are authorized to act, and you agree to use your own user names, logins, and passwords when accessing accounts on which you are authorized to act. You agree not to obtain or attempt to obtain unauthorized access to such parts of or features on the Site, or to any other protected information, through any means not intentionally made available to you by FindMyCareer.com.

You are responsible for maintaining the confidentiality of any user names, logins, and passwords that you use to access any page or feature on this Site, and for logging off of any protected areas of the Site. Website Licence

FindMyCareer.com grants you a limited, non-exclusive, non-transferable, non-assignable, revocable licence to view and temporarily download a copy of the materials displayed on the Site solely for your personal and non-commercial use for yourself or within your organization. User Submissions

The Site provides a forum for you to obtain employment and career information. By submitting or entering your information to the Site ("Submitted Material"), you agree that you grant FindMyCareer.com a perpetual, non-exclusive, irrevocable, royalty free, worldwide licence and right (but not the obligation) to use, copy, modify, display, distribute, download, store, reproduce, transmit, publish, transfer, adapt, create derivative works in any manner, in entirety or a portion, of your Submitted Material, and by any means.

You acknowledge and accept that FindMyCareer.com is only a passive forum for users to obtain employment and career information. FindMyCareer.com does not screen or monitor any Submitted Materials. FindMyCareer.com, therefore, makes no representation regarding the reliability, accuracy, completeness, validity, or truthfulness of any Submitted Materials. FindMyCareer.com reserves the right, in its sole discretion, to delete, remove, refuse to display, or block any Submitted Materials that tackmycareer.com considers to be unacceptable. In the event FindMyCareer.com receives notification regarding any unacceptable Submitted Materials, FindMyCareer.com may, at its sole discretion, investigate such materials.

You acknowledge and agree that FindMyCareer.com may retain copies of your Submitted Materials and disclose your Submitted Materials to a third party if FindMyCareer.com believes that it is necessary to: (i) protect the integrity of the Site; (ii) protect the rights of FindMyCareer.com; (iii) comply with any court order; (iv) comply with any legal proceedings; (v) assert FindMyCareer.com's claim under this Notice; and (vi) satisfy any claims regarding violations of third party's rights.

As one of the conditions of your use, you warrant and represent that you are a genuine and bona fide job applicant and that you are not using the website for any other purpose. It is YOUR RESPONSIBILITY to ensure that your use of the website complies with these Terms. In addition, in order to allow us to maintain a reliable and effective website, you specifically agree to refrain from intentionally providing any irrelevant, misleading or wrongful information and answers to questions or queries found on the website. You warrant and affirm that you will NOT:

  • Impersonate any person or entity, or otherwise misrepresent your affiliation with a person or entity;

  • Help or assist anyone else in completing any component of the website;
  • Provide any incomplete, false or inaccurate information on any application submitted for a job through the website;
  • Post or transmit any content or information that contains a virus, worms, Trojan horses, or corrupted data or any other contaminating or destructive features, or that otherwise interfere with the proper working of the website;
  • Publish, post, upload, distribute or disseminate any inappropriate, profane, defamatory, infringing, obscene, indecent or unlawful information;
  • Eavesdrop, commit electronic trespassing, fraud or forgery, sniff, spam, nuke, hack, spoof, break passwords, contaminate the website, cause unauthorized, damaging and/or harmful access and/or retrieval of information and data;

  • Indemnification.

    Each User agrees to indemnify, defend and hold FindMyCareer.com, its members, officers, directors, employees, agents and attorneys, harmless from and against any and all liabilities, claims, actions, suits, proceedings, judgments, fines, damages, costs, losses and/or expenses (including reasonable attorneys’ fees, court costs and/or settlement costs) arising from and/or related to: (a) any dispute between that User and any Employer, Job Search Service Provider or other third party; (b) User’s breach of the Agreement and/or any representation or warranty contained herein; and/or (c) User’s use of the Site Offerings in any manner whatsoever including, without limitation, that User’s Feedback. The provisions of this Section are for the benefit of FindMyCareer.com, its parents, subsidiaries and/or affiliates, and each of their respective officers, directors, members, employees, agents, shareholders, licensors, suppliers and/or attorneys. Each of these individuals and entities shall have the right to assert and enforce these provisions directly against you on its own behalf.

    Disclaimer of Warranties.

THE SITE AND/OR ANY OTHER PRODUCTS AND/OR SERVICES OFFERED BY AND/OR THROUGH SAME MAY CONTAIN BUGS, ERRORS, PROBLEMS OR OTHER LIMITATIONS. THIS LIMITATION APPLIES TO ALL CAUSES OF ACTION, IN THE AGGREGATE INCLUDING, BUT NOT LIMITED TO, BREACH OF CONTRACT, BREACH OF WARRANTY, NEGLIGENCE, STRICT LIABILITY, MISREPRESENTATION AND ANY AND ALL OTHER TORTS. IF APPLICABLE LAW DOES NOT PERMIT SUCH LIMITATIONS, THE MAXIMUM LIABILITY OF FindMyCareer.com TO ANY USER UNDER ANY AND ALL CIRCUMSTANCES WILL BE FIVE HUNDRED DOLLARS ($500.00). NO ACTION, REGARDLESS OF FORM, ARISING OUT OF THE SITE AND/OR ANY OTHER PRODUCTS AND/OR SERVICES OFFERED BY AND/OR THROUGH SAME, MAY BE BROUGHT BY ANY USER OR FindMyCareer.com MORE THAN ONE (1) YEAR FOLLOWING THE EVENT WHICH GAVE RISE TO THE CAUSE OF ACTION. THE NEGATION OF DAMAGES SET FORTH ABOVE IS A FUNDAMENTAL ELEMENT OF THE BASIS OF THE BARGAIN BETWEEN EACH USER AND FindMyCareer.com. ACCESS TO THE SITE WOULD NOT BE PROVIDED TO USERS WITHOUT SUCH LIMITATIONS. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS ON LIABILITY AND IN SUCH JURISDICTIONS THE LIABILITY OF FindMyCareer.com SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

    Severability

    If any part of these terms is held to be invalid or unenforceable under any applicable local laws or by an applicable court, that part shall be interpreted in a manner consistent with applicable law to reflect as nearly as possible our original intentions and the remainder of these terms shall remain valid and enforceable.

    Termination

    You agree that FindMyCareer.com, in its sole discretion and without liability to you or any third party, may suspend or terminate, with or without notice, your access to the Website and/or the Services or any part of them or any of your passwords or accounts within the Services, and may remove and discard any User Content within the Services, for any reason, including for lack of use or if FindMyCareer.com believes that you have violated or acted inconsistently with the letter or spirit of these Terms and Conditions Where there is a breach of these Terms and Conditions, FindMyCareer.com may also take any other action we reasonably deem appropriate in connection with such breach.

    Applicable Laws

    Any relevant terms and conditions, policies and notices shall be governed by and construed in accordance with the laws of USA without giving effect to any principles of conflict of law. You hereby consent to the exclusive jurisdiction of Massachusetts, USA in respect of any disputes arising in connection with the website, or any relevant terms and conditions, policies and notices or any matter related to or in connection therewith.
